Apologetic drug offender given a chance

An offender who was caught with cannabis in his underwear has been given a 12 month conditional discharge after claiming he has stopped using the drug.

Chesterfield magistrates’ court heard on Monday how Timothy Bennett, 18, of Holborn View, Codnor, was found with cannabis after he was involved in a road traffic collision.

Prosecuting solicitor Becky Allsop said: “The circumstances are that the police came across a parked Volkswagen Polo car which was involved in an RTC in Youlgreave.

“Bennett was with the vehicle and police could smell cannabis.

“A small amount of cannabis was recovered from a package in Bennett’s underwear.

“He made full admissions and said the drugs were his own for his personal use. Mr Bennett has no previous convictions but does have a caution for previously possessing cannabis.”

Bennett pleaded guilty to possessing a quantity of cannabis after the RTC incident in December.

Bennett, who represented himself in court, said: “I am very sorry. I was a regular user but I have not touched cannabis since the car crash. This has been the first time I have come to court and I intend it to be the last time.

“I know in myself I will not do it again. I do not want to come here again.”

Bennett has previously been given a caution in 2011 for possession of cannabis. Ms Allsop also submitted an application for the forfeiture and destruction of the drugs.

Magistrates sentenced Bennett to a 12 month conditional discharge but warned that if he commits another offence he will be brought back to court to be sentenced and dealt with for both offences.

Bennett was also ordered to pay £85 costs and a £15 victim surcharge.
