Breach of ban leads to jail

A heroin-plagued thief who breached a restraining order three times by contacting his ex-partner has been jailed for 12 weeks.

Chesterfield magistrates’ court heard on Monday how Luke Evans, 30, of Dawlish Court, Coniston Road, Newbold, Chesterfield, had been to his ex-partner’s home to wash clothes and have a bath despite being banned from seeing her by the courts.

Evans was also seen by police at her address, according to the court, and he was later found in her living room.

Prosecuting solicitor Angela Hadfield said Evans was subject to a restraining order on June 27, 2012, regarding protection from harassment which prevented contact with his ex-partner and attending her address.

Mrs Hadfield added: “She said there had been contact but he had asked to attend her address to wash clothes and to have a bath and she agreed because she felt sorry for him because he was homeless. He was also seen by police over two days at her address.”

Following the sightings on March 19 and 20, police stressed to the ex-partner that Evans had been prevented access and he was then found behind a sofa in her living room on March 22.

Evans pleaded guilty to breaching the restraining order three times and also admitted two thefts and breaching bail conditions.

The court heard how Evans had stolen food from Iceland and Asda in January and had been spotted by witnesses.

Julie Page, defending, said Evans had developed an addiction to heroin which had been the under-lying problem behind the thefts and the goods had been returned. Ms Page added his ex had contacted him by Facebook and he asked if he could visit, but Miss Page accepted any contact was still a breach of the restraining order.
