Breached order for the third time

A Glossop man has narrowly avoided prison after breaching a community order for the third time.

Ryan King had been given the order at Chesterfield Magistrates’ Court in October for offences of taking without consent and possession of cannabis.

But after breaching it for the third time, High Peak Magistrates’ Court revoked the order and re-sentenced him for the original offences, imposing a two-week prison sentence, suspended for 12 months.

Prosecutor John Cooper told the court that King had been found in possession of a motorbike belonging to another man on June 16, 2013.

The owner of the bike saw King with it so confronted him about it but he claimed he had found it under a blanket in Glossop.

He eventually handed the bike over to the owner and was later found guilty of taking it without consent after a trial.

When arrested for that offence, he was also found to be in possession of a small quantity of cannabis.

King, 23, of Chapel Lane, Hadfield, was due to attend for unpaid work on February 8 and 12 this year, but failed to attend either session and failed to provide verification for his absence within the required timescale.

Kirsten Collings, defending, said: “The original order was for 80 hours (unpaid work) and 35 hours have been added on for the breaches so there are 64 hours left to complete.

“In relation to February 8 he was ill but didn’t provide medical evidence.

“On February 12 he attended Sheffield for a specialist appointment in relation to a diagnosis which had been going on for quite a long period of time.

“He has now been diagnosed with Aspergers and ADHD.

“This means that his ability to manage his own affairs is less than others.”

King was also made subject to a six week curfew between the hours of 7pm and 7am.
