Nathan Walters attacked the woman at the home they had shared in Tennyson Way, Grassmoor, on February 23, just five days after neighbours had witnessed him throw the woman to the floor and straddle her.

Witnesses also claimed they had seen Walters punch his former partner, but he denied this allegation and the court accepted it did not happen.

Walters, 24, now of Mill Lane, Wingerworth, admitted two charges of assault by beating when he appeared before Chesterfield Magistrates’ Court on Wednesday, July 22.

Prosecuting, Becky Allsop said: “The complainant said they had been in a three-year relationship but separated last December, with them both accepting that it had come to an end.

“He asked her if she was seeing anyone else and he told him it was none of his business and he called her a slag. He headbutted her on the nose but later sent her a text saying he was so sorry.”

Mitigating, Steve Brint said that the former couple had a small child together and that Walters had previously had issues with alcohol and cocaine.

He said that the couple were still separated but now had an amicable relationship and their daughter stayed with Walters three nights a week.

He said: “It’s very difficult when a relationship breaks up, especially when there’s a small person involved. This had been a very good relationship until the back end of last year. He’s been under the Mental Health Service since he was 14 years old, and this spiralled because, rather than taking medication for his mental health, he started using drugs and alcohol.”

Sentencing Walters to 10 weeks in prison, suspended for 12 months, District Judge Jonathan Taaffe said: “Whatever your problems, there’s a little girl out there who needs you.”

He also ordered him to pay £85 costs and a £122 victim surcharge.
