Husband fined after attacking wife during 'canoodling' row

A husband has been fined after he attacked his wife and a police officer following a row over claims he had been canoodling with another woman.

Chesterfield magistrates’ court heard on Wednesday, July 20, how Russell Winfield, 56, of West Avenue, Ripley, grabbed his wife Lynn Winfield by the throat and pinned her down before he lashed out at a police officer.

Prosecuting solicitor Sarah Haslam said: “They had gone to a barbecue and while there the victim saw her daughter become angry with her father, the defendant, because she could not believe he had been canoodling with a female friend.

“An argument occurred and Lynn Winfield decided to go back to her address and when the defendant came back his wife told him to get his stuff and leave.”

The row developed, according to Miss Haslam, and the complainant threw her phone which struck the defendant and as they continued rowing Russell Winfield grabbed his wife by the throat and pinned her down.

Miss Haslam said a police officer attended and the defendant lashed out and grabbed the officer by his genitals before more police arrived.

Retired paramedic Winfield, who has no previous convictions, pleaded guilty to assaulting his wife and to assaulting the police officer after the incident on July 2.

Defence solicitor Paul McLeod said the couple had suffered a bereavement with the loss of a son and the situation after the barbecue was fuelled by Mr Winfield’s consumption of alcohol and anti-depressants.

Magistrates sentenced Russell Winfield to a 12-month community order. He was also fined £138 and must pay £200 compensation, an £85 victim surcharge and £85 costs.
