Nuisance ex is locked up

Chesterfield magistrates’ court heard on Monday, July 14, how Dale Tailby, 31, of Brendon Court, Holme Hall, Chesterfield, had already been sentenced for a criminal damage and a common assault concerning two ex-partners when he committed the breach.

Prosecuting solicitor Becky Allsop explained that Tailby had originally punched one of the complainants when he had turned up at her flat for which he received a suspended sentence and a restraining order.

But Mrs Allsop said: “Tailby breached that order when he visited this complainant again and banged on her window during a five minute period and when she found a bag outside her home with his belongings she contacted the police to say she felt scared and harassed.”

Tailby had already been resentenced for the criminal damage and assault after committing a further offence of using threatening behaviour towards police and was given 12 weeks’ custody suspended for 12 months with an alcohol treatment order on June 18.

But after the court heard how he turned up at his ex-partner’s flat and knocked on her window and left his belongings, on Sunday, July 13, he was arrested for breaching his restraining order.

Tailby pleaded guilty to visiting an ex-partner’s home when he was prohibited from doing so by a restraining order.

Defence solicitor Robert Sowter said Tailby was not aware his ex-partner was at home. Mr Sowter claimed the complainant had contacted him about getting the order removed.

Magistrates sentenced Tailby to 12 weeks of custody.
