Racist abuse at takeaway led to jail sentence

A thug who threatened and racially abused a fast food shop owner has been jailed for eight weeks.

Chesterfield magistrates’ court heard how Bryn Gillie, 21, of Station Road, Whitwell, became abusive to the takeaway owner at The Charcoal Grill, in Clowne.

Prosecuting solicitor Becky Allsop said: “Gillie appeared drunk and aggressive and made comments about the owner being Turkish and not being right with English people and he tried to get others to agree with him.

“The takeaway owner tried to calm him down but the defendant kept making racist comments.”

Gillie spat at the man and spat in a salad tray, according to Mrs Allsop, and also took a couple of swings at the complainant but missed.

Mrs Allsop told how the defendant also swore at the complainant who recorded some of the incident on his mobile phone.

CCTV footage also captured Gillie behaving in an aggressive manner, spitting and making haymaker swings at the complainant.

Mrs Allsop added: “Gillie took his shirt off saying he wanted to fight the complainant before smashing the takeaway counter and running out of the shop. He was arrested in an alleyway nearby.”

Gillie pleaded guilty to causing racially aggravated damage and using racially aggravated behaviour after the incident on July 12.

Defence solicitor Felicity Clarke said Gillie had been to a carnival and had too much to drink and claimed he knew nothing about the incident.

She said: “He knew nothing about the offence until he watched the footage. He felt very disgusted and in the officers’ opinions he was shocked and the defendant described his actions as disgraceful.”

The takeaway owner feared the incident may have cost him business.
