Thug head-butted and threw a bottle of milk at his ex-partner

Chesterfield magistrates’ court heard on Tuesday, June 14, how Daniel Marshall, 32, of Meadow Road, Holmegate, Clay Cross, had been in a volatile relationship with Leoni Kniveton and Marhsall had also been diagnosed with post traumatic stress disorder.

The defendant believed people with the mental health services had not been helping him and that his ex-partner had been involved with them in some way, according to the court.

Prosecuting solicitor Becky Allsop said: “They had been in a volatile relationship and they have a child and the complainant has children from a previous relationship.

“She states he believed she was involved in something and if anything happened he would blame her.

“She had her child in her arms at the top stairs in January and he head-butted her and took the child from her and held her child with one arm and he held a hammer in the other hand.”

The court also heard how Marshall accidentally stood on his partner’s pyjamas and dressing gown during the incident and she fell on a cot.

Marshall also threw a plastic milk bottle at his partner in March, according to Mrs Allsop, leaving her with bruising to her shoulder.

Mrs Allsop added: “During a further incident in April the complainant let Marshall into a house but he became agitated and he left and came back with a screw driver and he kept saying, ‘You’re all involved’.”

Marshall threw the screw driver and damaged a window and he had to be restrained by police as he came towards an officer with a sharp object and thrashed about during his arrest.

Marshall was found guilty of the January assault after an earlier trail and he pleaded guilty on Tuesday to a further assault, causing damage and resisting a police constable.

Defence solicitor John Wilford said Marshall had not meant to step on his partner’s dressing gown and the bottle of milk he had thrown had been plastic.

He added that Marshall felt people in the mental health services had set him up and given him the problems he has in his life.

Magistrates sentenced Marshall to a 26 week custodial sentence and imposed an indefinite restraining order for him not to contact his former partner.

Marshall was also ordered to pay £100 compensation, £620 costs and an £80 victim surcharge.
